1. Acceptance of Terms

By accessing or using Beverly Hills Lux Car Service ("we," "our," or "us"), whether through our website, mobile application, or direct communication, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Beverly Hills Lux Car Service regarding your use of our website, mobile application, and transportation services. By making a reservation or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1.1 Regulatory Compliance

Beverly Hills Lux Car Service operates in full compliance with all applicable federal, state, and local laws and regulations governing luxury transportation services. We maintain all required licenses, permits, and insurance coverage as mandated by the California Public Utilities Commission, the Los Angeles Department of Transportation, and other relevant regulatory authorities. 2. Service Description

Beverly Hills Lux Car Service provides luxury transportation services using Cadillac LYRIQ electric vehicles in and around Beverly Hills, Los Angeles, and surrounding areas. Our services include:

  • Airport transfers to and from LAX, Burbank, and other regional airports
  • Corporate transportation for executives and business professionals
  • Special event transportation for weddings, galas, premieres, and other occasions
  • Hourly charters for shopping, sightseeing, and personalized excursions
  • Point-to-point transportation throughout the Greater Los Angeles area

We pride ourselves on providing the highest level of service, comfort, and professionalism to meet the transportation needs of our discerning clientele.

2.1 Subcontracting Rights

Beverly Hills Lux Car Service reserves the right to subcontract services to our network of trusted partner transportation companies when necessary due to high demand, vehicle availability constraints, service area limitations, or other operational considerations. Any subcontracted service will be provided by operators who meet our strict standards for quality, safety, and professionalism. All terms and conditions contained herein apply equally to services provided directly by us or by our subcontractors. By booking with us, you consent to the potential subcontracting of your reservation.

2.2 Vehicle Substitution

While we make every effort to provide the specific vehicle type requested, we reserve the right to substitute vehicles of equal or greater value without prior notice in the event of mechanical issues, previous trip delays, or other circumstances beyond our control. In such cases, we will make every reasonable effort to notify you of the substitution as soon as practicable. If the substituted vehicle is of higher value than the one reserved, there will be no additional charge. If we can only provide a vehicle of lesser value, we will adjust the price accordingly and refund the difference.

3. Booking and Reservations

3.1 Reservation Process

Reservations can be made through our website, via phone at +1-818-300-8464, or by email at book@bhluxcars.com. All reservations are subject to vehicle and chauffeur availability. We recommend making reservations at least 24-48 hours in advance to ensure availability, especially during peak times and holiday seasons.

3.2 Reservation Confirmation

When you make a reservation, you will receive a confirmation email with the details of your booking, including the date, time, pickup location, destination, vehicle type, and pricing information. It is your responsibility to review this information carefully and notify us immediately of any discrepancies or issues. Your reservation is not confirmed until you receive this confirmation email and your payment method has been processed successfully.

3.3 Service Modifications

Any modifications to your confirmed reservation must be communicated to us as soon as possible. Changes to your itinerary, including pickup time, location, or additional stops, may result in price adjustments. We will make every reasonable effort to accommodate your requests, but cannot guarantee that all changes can be accommodated, especially if requested less than 24 hours before service.

4. Electronic Communications Consent

By providing your email address and/or phone number during the reservation process, you consent to receive electronic communications from us. These communications may include:

  • Reservation confirmations and updates
  • Service notifications, including chauffeur information and estimated arrival times
  • Payment receipts and invoices
  • Feedback requests and service surveys
  • Marketing communications about special offers and promotions (subject to your marketing preferences)

You may opt out of marketing communications at any time by following the unsubscribe instructions included in each marketing email or by contacting us directly. However, you cannot opt out of service-related communications that are essential to fulfilling your reservation or processing your payment.

Standard text messaging and data rates may apply for SMS communications. By providing your mobile number, you consent to receive text messages related to your reservation.

5. Cancellation Policy

5.1 Standard Reservations

Our cancellation policy for standard reservations is as follows:

  • Cancellations made 24 hours or more before your scheduled service receive a full refund.
  • Cancellations within 12-24 hours of scheduled service incur a 50% fee.
  • Cancellations less than 12 hours before service or no-shows are charged in full.

5.2 Special Events and Peak Seasons

For special events (weddings, awards ceremonies, major sporting events) and peak seasons (holidays, graduation periods), the following cancellation policy applies:

  • Cancellations made 72 hours or more before your scheduled service receive a full refund.
  • Cancellations within 48-72 hours of scheduled service incur a 50% fee.
  • Cancellations less than 48 hours before service or no-shows are charged in full.

5.3 Corporate Accounts

Corporate accounts may have custom cancellation terms specified in their separate agreements. Please refer to your corporate agreement for specific details.

6. Payment Terms

6.1 Payment Methods

We accept all major credit cards (Visa, MasterCard, American Express, Discover) and digital payment methods (Apple Pay, Google Pay). Cash payments are not accepted except in pre-approved circumstances. For corporate accounts, billing terms will be specified in your agreement.

6.2 Deposit and Payment Processing

A valid credit card is required to confirm all reservations. For standard reservations, we will charge a 25% deposit at the time of booking, with the remaining balance processed automatically the day before service. For reservations made less than 24 hours in advance, the full amount will be charged at the time of booking.

6.3 Gratuities and Additional Charges

A 20% gratuity is automatically added to all reservations. Additional gratuity is at your discretion and can be provided directly to your chauffeur or added to your final charge upon request.

Additional charges may apply for:

  • Wait time beyond the complimentary wait time allowance (billed in 15-minute increments)
  • Additional stops not included in the original reservation
  • Route changes or extended service time
  • Tolls, parking fees, or other travel-related expenses
  • Excessive vehicle cleaning due to spills, stains, or other damages

All additional charges will be processed to the payment method on file after service completion.

6.4 Tax Responsibility

All rates and prices quoted are exclusive of applicable federal, state, and local taxes unless explicitly stated otherwise. All required taxes will be added to your final bill and clearly itemized on your receipt. For corporate clients and tax-exempt organizations, valid tax exemption documentation must be provided prior to service for tax exemptions to be applied.

6.5 Gift Certificates and Promotional Credits

Gift certificates and promotional credits are subject to the following terms:

  • Gift certificates are valid for one year from the date of purchase unless otherwise specified
  • Gift certificates are non-refundable but are transferable
  • Promotional credits may have specific expiration dates and usage restrictions as communicated at the time of issuance
  • Gift certificates and promotional credits cannot be combined with other offers or discounts unless explicitly permitted
  • No cash back will be provided for any unused portion of a gift certificate or promotional credit
  • Lost or stolen gift certificates may be replaced only if proof of purchase is provided

7. Airport Pickups

7.1 Flight Tracking and Wait Time

For airport pickups, we provide flight tracking at no additional charge. Your chauffeur will monitor your flight status and adjust their arrival time according to your actual arrival time, not your scheduled arrival time. We provide complimentary wait time of:

  • 30 minutes for domestic flights (after actual arrival time)
  • 60 minutes for international flights (after actual arrival time)

Additional wait time will be billed at our standard hourly rate in 15-minute increments.

7.2 Meeting Points

For domestic airport pickups, your chauffeur will meet you at the baggage claim area for your airline, holding a sign with your name. For international airport pickups, your chauffeur will wait at the designated meeting point after customs. Specific meeting instructions will be included in your reservation confirmation.

7.3 Early Arrivals

If your flight arrives earlier than scheduled, we will make every effort to have your chauffeur available upon your arrival. However, we cannot guarantee immediate pickup for flights that arrive more than 30 minutes earlier than scheduled without prior notification.

8. Client Conduct

8.1 General Conduct

Clients and all passengers must adhere to the following conduct guidelines:

  • No smoking, vaping, or use of illegal substances in our vehicles
  • No consumption of alcoholic beverages by persons under the legal drinking age
  • No behavior that may distract the chauffeur or compromise the safety of the service
  • Compliance with all applicable laws and regulations during service
  • Respect for the chauffeur, vehicle, and other passengers at all times

8.2 Vehicle Care and Damage

Clients are responsible for any damage to the vehicle caused by them or their guests during service, including but not limited to:

  • Stains or damage to upholstery or interior components
  • Damage to electronics or entertainment systems
  • Breakage of glassware or other amenities
  • Excessive cleaning required due to spills, food, or other substances

The cost to repair any damage or for excessive cleaning will be charged to the credit card on file. A minimum cleaning fee of $250 applies for any bodily fluid cleanup.

8.3 Service Termination

We reserve the right to terminate service without refund if client conduct violates these guidelines or poses a safety risk. This includes but is not limited to:

  • Abusive, disrespectful, or threatening behavior toward the chauffeur or other passengers
  • Illegal activity of any kind
  • Excessive intoxication that leads to disruptive or unsafe behavior
  • Requests for the chauffeur to violate traffic laws or safety protocols

8.4 Service Animals and Accessibility

In accordance with the Americans with Disabilities Act (ADA) and applicable state laws, we welcome service animals in our vehicles. A service animal is defined as a dog that is individually trained to do work or perform tasks for a person with a disability. We do not charge additional fees for service animals.

Clients with service animals should notify us at the time of booking to ensure appropriate accommodations. While we welcome service animals, we may charge a cleaning fee if a service animal causes damage or soiling beyond normal shedding.

Our vehicles can accommodate most wheelchairs and mobility devices. Please inform us of any accessibility requirements at the time of booking so that we can ensure the appropriate vehicle and assistance are provided.

8.5 Minors Policy

Passengers under 18 years of age must be accompanied by a parent or legal guardian unless prior arrangements have been explicitly made and approved by Beverly Hills Lux Car Service. For unaccompanied minors (with prior approval), the following conditions apply:

  • A parent or legal guardian must complete and sign our Unaccompanied Minor Form prior to service
  • The minor must be at least 16 years of age
  • The parent or guardian must provide direct contact information and remain reachable throughout the duration of the service
  • A parent or authorized adult must be present at both the pickup and drop-off locations

For passengers traveling with infants and young children, appropriate car seats or booster seats are required by law. Clients must provide their own child safety restraints unless arranged in advance (additional fees may apply). Our chauffeurs are not responsible for the installation of car seats or the restraint of children during transport.

9. Limitation of Liability

9.1 Service Delays

While we strive to provide punctual and reliable service, we cannot guarantee against delays caused by factors beyond our control, including but not limited to:

  • Traffic congestion or road closures
  • Adverse weather conditions
  • Natural disasters or emergencies
  • Mechanical issues despite regular maintenance
  • Events that impact traffic flow (parades, protests, filming)

In the event of such delays, our liability is limited to providing a credit for a future service or a partial refund at our discretion. We are not responsible for costs, expenses, or damages resulting from such delays.

9.2 Insurance Coverage

We maintain comprehensive insurance coverage for our vehicles and passengers as required by law. However, our liability for any loss, damage, personal injury, or death is limited to the extent permitted by applicable law and to the coverage limits of our insurance policies. By using our services, you agree to these limitations.

9.3 Force Majeure

We shall not be liable for failure to perform any obligation under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, labor disputes, government regulations, natural disasters, severe weather, pandemics, or major health concerns.

10. Indemnification

You agree to defend, indemnify, and hold harmless Beverly Hills Lux Car Service, its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of our services, including but not limited to any use of our website, mobile application, or transportation services
  • Your violation of any third-party right, including without limitation any intellectual property right, privacy right, or proprietary right
  • Any harm, damage, injury, or loss to any person or property caused directly or indirectly by you during the provision of our services
  • Your negligent or more culpable act or omission in connection with our services

11. Lost Items

While we make every effort to locate and return lost items, we are not responsible for items left in our vehicles. If you believe you have left an item in one of our vehicles, please contact us as soon as possible at +1-818-300-8464 or lost@bhluxcars.com with a description of the item and details of your trip.

If we locate your item, we will notify you promptly. Items will be held for 30 days, after which unclaimed items will be donated to charity or disposed of as appropriate. We may charge a reasonable fee for the return of lost items, based on shipping costs and staff time required.

12. Photography and Marketing

We may occasionally take photographs or videos of our vehicles and services for marketing and promotional purposes. By using our services, you grant us permission to take such photographs or videos and to use them in our marketing materials, including on our website, social media accounts, and print advertisements, subject to the following conditions:

  • We will always seek your explicit consent before using any images that clearly identify you or your guests
  • We will not use images in a manner that would reasonably be considered embarrassing, unflattering, or compromising
  • You may request the removal of any specific image featuring you from our marketing materials at any time

This permission is granted without expectation of compensation or other remuneration, and you waive any right to inspect or approve the finished product wherein your likeness appears if you have provided consent for its use.

13. Intellectual Property

The Beverly Hills Lux Car Service name, logo, website, images, and content are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or display any portion of our website or content without prior written permission from us. All rights not expressly granted herein are reserved.

14. Changes to Terms

We reserve the right to modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to our website. Your continued use of our services after such changes constitutes your acceptance of the new Terms. We recommend that you review these Terms periodically to stay informed of any updates.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

Before initiating any legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us. Both parties agree to negotiate in good faith to achieve a mutually satisfactory resolution.

15.1 Class Action Waiver

You and Beverly Hills Lux Car Service agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative action. Unless both you and Beverly Hills Lux Car Service agree otherwise, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding. Any arbitration or court proceeding shall be conducted on an individual basis and not in a class, consolidated, or representative action.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Any such provision shall be deleted without affecting the remaining provisions herein.
